I-140 Checklist:

1. Cover letter signed by employer explaining documents enclosed and
requesting I-140 approval by USCIS

2. Completed I-140 form signed and dated by employer

3. $195 check or money order payable to "Department of Homeland Security" (
application fees be attached to the first page of I-140 form)

4. Original ETA 9089 (PERM approval issued by DOL signed by you & by your
employer)

5. Copy of appropriate degree (earned from a university) (as required in the
labor certification)

6. Experience letters for X years (needed only if your labor certification
requires X years of experience)

7. Copy of transcripts for university degree (grade report or markssheets).

8. Company’s annual report or tax returns or audited financial statement (
one of these to be submitted as a "primary evidence" of ability to pay)

9. Last 2 or 3 years W-2s (to prove you are already getting more than the
salary stated on labor ever since the priority date to current date).

10. Last 3 months (recent) pay stubs (to prove you are already getting more
than the salary stated on labor for the current year for which you don’t
have W-2 yet).

11. Your company’s CFO's letter stating that the company has financial
ability to pay. (only if your company has over 100 employees)
NOTE: Acceptance of CFO letter by USCIS is discretionary (they don’t accept
it in all cases. So it is better to a submit primary evidence of ability to
pay)

First, I will need to know the current immigration status (B-1, F-1, etc.) of the applicant. The applicant must hold valid status in order for us to file on her behalf.
DOCUMENTS REQUIRED:
Complete copy of current passport, including the blank pages. Please be
sure I-94 information is legible
Birth certificate, affidavit of birth details, or family registry with
certified English translation
Current US license as Registered Nurse
Copy of passing IELTS or TOEFL results. (Note: Results are good for 2 years)
Nursing diploma or certificate of graduation
Nursing transcript
License as Registered Nurse (US and country of origin if applicable)
Form I-693 medical form in a sealed envelope
8 photos per Nurse applicant
Copies of Form I-20 (if applicable)
Copy of marriage certificate (if applicable)

If the applicant has her §343 Healthcare Certificate (“VisaScreen”),
please include a copy. If she hasn't yet applied for the VisaScreen, please
be sure she does so immediately. Please note: The VisaScreen Certificate is
only good for 5 years.

Once the applicant has completed the Questionnaires, I will prepare her
forms (immigration forms like i-140)for signature. Once the forms are
returned to me along with the documents listed above (including photos and
medical form), we will file her application with the USCIS.

1、EB3指什么，有什么要求？

EB3是美国职业移民的一种，分别技术类和非技术类。技术类要求有二年以上的工作经验，比如：厨师、电工这类就属于技术类。
非技术类（就是EW）：不须要有工作经验的，中国人最常见的清洁工，食品加工厂、养鸡厂。
EB3学历高求不高的，特别是非技术类的，只要求初中以上学历，年龄要求在21-55周岁，年龄上限大。

2、关于EB3的普通劳工卡、转名劳工卡，IRI的之间区别以及什么叫PERM？
普通劳工卡：是以本人名字申请的劳工卡，要经过登报招人等一系列的程序，光在登报招人上面的公示期就要有三个月了，然后申请成功的时间还要看各洲的情况，有的洲很快就批了，有的洲时间长达三年以上都有的。

EB3的转名通俗的来说，就是你的中介以前以别人的名字申请到一张劳工卡，然后申请的到这个人因某种原因不能去了，但劳工卡已经申请下来了，按照法律，劳工卡申请下来以后是终身有效的，是可以转让的。那么你的中介把这个劳工卡以转名的方式换成你的名字，这样可以说是节约了许多申请劳工卡这方面的时间，以已前的经验来说，劳工卡的成功申领与否就解决了这个个案申请的成功的80%。转名的在时间上是有优势的。

IRI：是快速劳工卡。这个主要看你申请雇主的实力。一般ＩＲＩ的时间会在半年内下来。

PERM：是2005年颁布一项关于加快劳工卡申请的一项政策，正式实施时间是2005年3月28日，美国政府为了改善各洲劳工卡的申请速度，特别制度了这项政策的，政策规定以前申请的劳工卡在未审批出来的现都积中在费城和达拉斯的积压中心，处理时间为24-30个月。现申请劳工卡的话，时间在45-90天内有结果，PERM是机审，是会存在的一定的风险的，并不是每个案子都能过的。规定中注明，普通的案子是可以转为PERM的排期也是可以不变的```````可以说，如果PERM实施下去的话，在申请劳工卡这个环节上将会节约一定的时间。

3、什么是ETA750表、I140、I797C、I797、DS230表、I8——表？

ETA750表：劳工卡申请表
I140表：申请移民的表格
I797C：移民局收件表
I797：移民局批准函
DS-230表：家庭成员履历表
I8——表：经济担保书

说明：因为我是请了中介的，有一些的表格我没有填过的，我只填过就是DS230表，这个表和I8——表都出现在P3中

4、EB3流程时间表（参照）

在转名情况下，从申请劳工卡到I140的批准，到收到I797批准件在一年时间左右。
然后要交380元的签证费，在1-2个月的时间内会收到包裹3（也就是我们所说的P3）。包裹3里面含有DS230表（第一和第二部分）和I8——表，不过请过中介的朋友就知道了，我们只填230表的第一部分，余下的中介会帮你搞定的。230表的第二部分以及其他的材料会在你收到P4宝宝面见的时候出现的````````

收到I797表就表示你的移民申请被移民局批准了。他们会让NVC（美国移民签证中心）给你寄P3啦
填好230表以后，寄给NVC就开始名调了
名调：名字调查，主要是查你的名字是否在恐怖分子之列，时间一般是在1-3个月之间，在911之前一般都只要1个半月这样的，现在好像大家都足3个月，当然如果你的名字与那些人有相似之处，那有可能会进行二次背调，那么时间还是以1-3个月为一个周期的，在调查后认为没有问题后，就会把你的材料寄往广州。

背调 ：这是材料到广州以后进行的背景调查，主要是对你的经济、刑事方面的调查，一般是没有多大的问题的。时间也在1-3个月这样，一般在背调之后吧，就会通知你面试啦。面试的时间一般会在材料到广州以后的3-6个月。
